Membership Agreement

This Membership Agreement governs seller accounts and listings on the paultan.org used-car classifieds (the “Service”), operated by Driven Communications Sdn Bhd (“Driven”, “we”). It applies together with the Terms of Service and the Privacy Notice. By creating a seller account or publishing a listing you agree to this Agreement.

1. The account

• A seller account is a personal account tied to one verified Malaysian mobile number, and is strictly non-transferable. Login is by one-time code sent to your WhatsApp; you are responsible for the security of your number and device.
• Individuals (“Private sellers”) must be 18 years or older and capable of entering into a legally binding agreement under Malaysian law.
• Businesses (“Pro sellers”) — dealers and other business entities must register as Pro sellers and display their business name. Any person using the Service on behalf of a business represents that he or she has authority to bind that business to this Agreement. We may reclassify accounts that show trade activity.
• Listings must be placed for the benefit of the account holder, not a third party.
• Your verified mobile number is shown to buyers as the WhatsApp contact on your listings — that is the Service’s contact model. A verified email address is required before purchasing credits; receipts and account notices are sent there.

2. Listings and review

• One listing describes one actual vehicle that is in your possession (or your business’s), genuinely for sale in Malaysia at the stated price.
• All details — year, mileage, condition, ownership, accident history, price — must be accurate and not misleading, and photographs must be of the actual vehicle.
• Every listing is reviewed by Driven before it goes live. We may reject or edit a listing at our discretion, and may remove a published listing that breaches this Agreement at any time.
• An approved listing runs for 90 days, after which it ends automatically. Ended listings can be relisted (a new fee applies and the listing is reviewed again). Private sellers may have at most 2 listings live or in review at any time; Pro sellers are not capped.
• The positioning and presentation of listings is at Driven’s discretion. Driven may also display your listing on other websites, social platforms and advertising catalogues (for example, syndicated advertising feeds) without further permission — this is part of promoting your listing.

3. Prohibited listings

Without limiting the foregoing, the following are prohibited and can be removed without notice:

• content not related to the vehicle being advertised — especially photos or videos of anything other than the vehicle, or any listing with false information;
• vehicles you do not have the right to sell, stolen or salvage vehicles, or vehicles with tampered odometers;
• listings that promote illegal business practices, or violate any applicable law, regulation or third-party rights, including the Personal Data Protection Act 2010;
• duplicate listings of the same vehicle, placeholder or “call for price” listings;
• content that, in Driven’s sole and absolute judgment, is inappropriate, or could result in legal liability or adverse publicity to Driven, such as offensive, inaccurate, defamatory or infringing material.

4. Credits, fees and refunds

• Publishing a listing costs prepaid credits, purchased in advance by card or online banking through our payment provider (2C2P). Current pricing is shown at the pricing page; drafts are free, and the fee is only charged when a listing is submitted for review.
• The listing fee is refunded to your credit balance automatically if we reject your listing during review, or if you recall it before we review it. Withdrawing a live listing, or its natural expiry, earns no refund.
• Credits are otherwise non-refundable and non-transferable, have no cash value, and may be forfeited on accounts terminated for breach of this Agreement.
• Driven does not store your card details; payments are processed by 2C2P.
• Driven reserves the right to revise listing fees and credit pricing at any time; changes apply to future purchases and submissions, not to listings already live.

5. The sale itself

Driven is a listing venue only. We are not a party to, and accept no responsibility for, the sale, the vehicle’s condition, payment between you and the buyer, transfer of ownership, or anything that happens at or after a viewing. You are responsible for complying with all applicable law, including JPJ ownership-transfer requirements and, for dealers, any licensing obligations. Editorial review of a listing is not an inspection, valuation or endorsement of the vehicle.

6. Limitation of liability and indemnity

Driven shall not be liable for (1) the content or quality of any listing, (2) disruptions or interruptions of the Internet which affect your listing, (3) errors or delays in providing the Service, (4) loss of seller data, or (5) any delay or failure in performance caused by events beyond Driven’s reasonable control. In consideration of publication of a listing, the seller agrees to fully indemnify and hold harmless Driven, its officers, agents and employees in respect of all costs, expenses, losses, damages, claims, actions or proceedings arising out of or in relation to the publication of the seller’s listing, including claims in respect of libel, slander, violation of privacy rights, copyright infringement or violation of any other intellectual property rights.

7. Enforcement and termination

We may suspend or terminate accounts for breaches of this Agreement, suspected fraud, or misuse (including scraping, fee circumvention, or repeated misdescription). Suspending an account takes its live listings off the Service. Takedown requests (for example, a vehicle listed without authority) can be sent to the contact details in the Privacy Notice and will be actioned promptly.

8. General

This Membership Agreement, the Terms of Service and the Privacy Notice (collectively, the “Terms”) constitute the entire understanding between the parties regarding their subject matter and supersede any prior agreements or representations, written or oral. All listings and credit purchases are subject to Driven’s then-current Terms, which may be revised by Driven at any time. The Terms are governed by and construed in accordance with the laws of Malaysia.
