Police issue 8,718 summonses on first day of Op Saman Ekor – compounds sent to offenders’ homes

The police have issued 8,718 summonses as part of a postal summons operation for speeding dubbed Op Saman Ekor that began on Monday (August 21, 2023).

As reported by Bernama, Bukit Aman JSPT (traffic investigation and enforcement department) deputy director Datuk Mohd Nasri Omar revealed motorists (car drivers) accounted for the bulk of summonses issued with 8,352. Meanwhile, commercial and service vehicles recorded a total of 322 summonses, followed by motorcyclists with 44 summonses.

“A K170A summons notification for speeding will be delivered to the vehicle owner according to the driver’s licence address by registered post (as opposed to a summon on the spot). All (postal summonses) for speeding offences can be settled at any police district traffic offices in the country,” said Mohd Nasri.

The JSPT uses high-speed cameras to catch any driver violating the speed limit, with a RM300 compound being posted to the purported offender. Mohd Nasri added that driving above the speed limit is one of the main causes of road accidents in the country where speeding drivers fail to control the vehicle.

    these speed traps, do they also catch speeding motorcycles and bikes on public roads and highways? on highways often met these bikes speeding way above speed limits and worse, they zig zag between cars dangerously.

      Without the Adaptive Cruise Control daily driving can be so stressful. It help me to control max speed and follow car in front instead of simply overtaking him and kena speeding saman.

    I thought PDRM has already issued SOP on how to set up speed traps, and that includes officers not hiding in drains, bushes etc?

    a) Apa itu Saman Ekor

    JPJ : Saman ekor merupakan notis kepada pemilik kenderaan untuk memberi maklumat butiran pemandu kenderaan di bawah Seksyen 115 Akta Pengangkutan Jalan 1987 yang melakukan kesalahan yang berkenaan. Notis ini akan dihantar ke alamat pemilik kenderaan yang terdapat dalam pangkalan data JPJ. Istilah rasmi bagi saman ekor ialah Notis Pol.170A.

    KDN : Saman ekor ialah saman yang dikeluarkan oleh mahkamah berikutan daripada satu notis yang dikeluarkan oleh pihak PDRM melalui borang polis yang dikenali sebagai borang POL 170A. Saman ini dikeluarkan berikutan atas kegagalan mematuhi notis POL 170A yang dikeluarkan oleh pihak PDRM. – Hansard Dewan Rakyat D.R. 29112010

    Kesimpulannya

    Saman Ekor ini bukan saman tetapi hanya Notis Meminta Maklumat Pemandu.

    b) Penyampaian Saman Ekor.

    Saman ekor dihantar secara pos berdaftar kepada pemilik kenderaan.

    Penyampaian apa-apa notis boleh dibuat melalui Pos A.R Berdaftar mengikut Seksyen 118 APJ 1987.

    Isu :
    i) Adakah notis itu benar-benar dikeluarkan?
    ii) Adakah notis itu telah disampaikan?
    iii) Adakah notis itu sempurna diserahkan?

    c) Prosedur Saman Ekor (Notis Seksyen 115 – Pol 170A)

    i) Kenderaan yang melakukan kesalahan dikenalpasti.
    ii) Notis dikeluarkan, disampaikan dan diserahkan kepada pemilik berdaftar kenderaan.
    iii) Dalam tempoh tujuh (7) hari pemilik kenderaan hendaklah memaklumkan butiran pemandu yang memandu semasa kesalahan dikatakan telah dilakukan.
    iv) Jika gagal memberikan maklumat setelah tamat tempoh boleh dikeluarkan saman kerana ingkar notis.

    d) Apa itu Kompaun?

    Kompaun adalah tawaran denda jika orang yang kena saman (OKS) mengaku melakukan kesalahan dan ingin menyelesaikan denda di luar Mahkamah.
    i) Adakah kompaun itu bayaran mandatori/wajib?

    Tidak, kompaun adalah tawaran sahaja. Jika tidak menerima tawaran, pihak yang menawarkan kompaun boleh mengambil tindakan lanjut.

    ii) Adakah kompaun diperuntukkan dalam Undang-Undang?

    Ya melalui Seksyen 120 APJ 1987

    e) Kesan ingkar kompaun.

    Pihak yang menawarkan kompaun boleh mengambil tindakan lanjut iaitu dengan mengeluarkan saman kepada OKS.

    Isu a) Dalam kes saman ekor – adakah saman dikeluarkan? – TIDAK

    f) Apa itu SAMAN?

    Saman ialah suatu notis gantian perintah daripada Mahkamah supaya orang yang kena saman (OKS) hadir ke Mahkamah.

    Saman dikeluarkan mengikut Seksyen 53 (1) APJ 1987.

    g) Kandungan Saman.

    Setiap saman hendaklah mengandungi perkara-perkara berikut :-

    Lokasi Mahkamah
    Tarikh kehadiran
    Masa kehadiran
    No. Pendaftaran kenderaan
    Jenis kenderaan
    Jenis kesalahan
    Tempat kesalahan
    Masa kesalahan

    h) Penyampaian Saman

    Seksyen 53 (1) APJ 1987 menyatakan hendaklah diserahkan serta-merta kepada OKS dan hendaklah dibuktikan serahan telah dibuat.

    i) Kesan ingkar Saman

    Jika Saman dibuktikan telah diserah dan OKS tidak hadir ke Mahkamah pada tarikh dan masa yang ditetapkan, maka Mahkamah boleh mengeluarkan Waran Tangkap mengikut Seksyen 53(2) APJ 1987.

    j) Hukuman

    Jika saman telah diserah dan OKS hadir, OKS boleh samada hendak mengaku salah atau minta dibicarakan.

    a) Jika mengaku salah – hukuman akan dijatuhkan oleh Mahkamah.
    b) Jika dibicarakan – bergantung kepada keputusan samada kesalahan dibuktikan atau tidak. Jika dibuktikan maka akan dijatuhkan hukuman. Jika tidak dapat dibuktikan maka akan dilepaskan.

    k) Penguatkuasaan.

    Jika hukuman telah dijatuhkan terhadap OKS maka OKS hendaklah memenuhi perintah hukuman samada membayar denda, penjara dan sebagainya.

    Jika denda dibayar maka selesai kes saman tersebut. Jika tidak dibayar maka OKS akan dipenjarakan.

  • PDRM should automatically offer the discounted rate because no one is going to pay at first, and a discount will be offered at a later date anyway. So why bother with RM300 summon? Just reduce it to RM50 straightaway.

      Then where is the deterrent effect? RM 50 isn’t the same hit as RM 300. Might as well call it speeding tax then. Make it RM 1000, go tell sob story la, rayuan la, jual bontot whatever and then reduce to RM 300. Jangan diskaun, bila rasa sakit then only behaviour will change.

        Our brainless law enforcement in this country does not provide any deterrence for traffic offences nor do they enforce against traffic offences. Every single day on the highways and trunk roads we see cops doing the easy job of stopping motorcyclists to extort money, but they will not notice cars using the emergency lane and heavy vehicles that tailgate smaller vehicles at way above the speed limit.

        This is what you get when the force consists of poor academic performers who sign up to be cops, similar to how uneducated youths got deployed as soldiers in the Vietnam war because there were not many other career options for imbeciles.

        • Car owners blame polis for alwiz saman them and stopping them in roadblocks but never catch motor riders.
          Motor riders complain polis alwiz catch them for kopi but never notice cars using emergency lane and heavy vehicles that tailgate smaller vehicles.

    this is a waste of polis resources. Poor man need to sit in the heat to catch people. Just follow what 1st world countries do. They check the toll-in and toll-out times. If a car has been speeding, then it will receive a summons based solely on the time. eg at 110kmh for 100km stretch of road, if the car exist in a quicker time, that means he has been speeding = summons.

      I was in Taipei and you are right, the taxi driver told me that is how the catch speeding motorists. You enter the gate and exit time is calculated by computer. if its faster that the allowed speed limits, you automatically get demerits.
