Malaysian prime minister Datuk Seri Anwar Ibrahim has said the ministry of investment, trade and industry (MITI) is reviewing the United States Supreme Court’s recent decision to strike down US president Donald Trump’s sweeping tariffs imposed under the International Emergency Economic Powers Act (IEEPA), reports NST.
He added that MITI is currently in discussions with both Washington and ASEAN partners to determine the next course of action. “Regarding the tariffs, [MITI minister] Datuk Seri Jo (Johari Ghani) has already provided an explanation, and we will receive a detailed briefing before we respond. We will wait for Friday’s Cabinet meeting,” Anwar said.
On Friday (February 20, 2026), the US’ top court, in a 6-3 ruling, upheld a lower court’s decision that Trump’s use of a 1977 law exceeded his authority. Shortly after, Trump took to his Truth Social platform to lambast the court’s decision and said he would replace the tariffs scrapped by the court with a 10% levy on all goods entering the US.
According to a fact sheet published by the White House, Trump is invoking his authority under section 122 of the Trade Act of 1974. The newly signed proclamation allows for a temporary import duty (10% in this case) to be imposed for a period of 150 days – this will take effect on February 24, 2026.
Trump later announced on Saturday (February 21) that this global tariff would be increased to the maximum allowed legal limit of 15%, although the White House has not issued a new fact sheet for this revision. “During the next short number of months, the Trump administration will determine and issue the new and legally permissible tariffs, which will continue our extraordinarily successful process of making America great again – greater than ever before!” Trump wrote on Truth Social.
