Road users involved in accidents caused by damaged road surfaces are eligible to claim compensation from the relevant authorities, according to the Johor state government, New Straits Times has reported.
Claims for damages must be supported by clear evidence and documentation, said Johor public works, transport, infrastructure and communications executive councillor Mohamad Fazli Mohamad Salleh.
This comes after a motorist was awarded compensation of RM721,000 by the Johor Bahru Sessions Court for losses incurred due to road damage. “If an accident occurs, or a vehicle is damaged due to road defects, road users can submit a claim to the concession company responsible for maintaining the route,” the Johor exco said.
In the event any damage is sustained due to damaged roads, motorists are advised to provide photographs of the incident, vehicle damage, the condition of the road involved, the location and time of the incident, a police report, as well as any relevant receipts, he added.
“A formal letter can then be submitted to the appropriate authority, such as the local council, the Public Works Department, or the Malaysian Highway Authority,” Mohamad Fazli said.
