Luxury car owners allegedly skipping out on paying road tax and insurance because the fines are cheaper

Owners of luxury vehicles are allegedly choosing not to renew their road tax and insurance because the fines are cheaper, according to a senior lawyer. As reported by NST (citing Bernama and Berita Harian, Muhammad Hasif Hasan was told by a product founder that it was more cost-effective to pay a maximum fine of RM3,000 for not having the required documents compared to paying thousands of ringgit needed to renew a vehicle’s road tax and insurance.

This comes after the road transport department (JPJ) conducted Ops Luxury and Ops Luxury 2.0 in recent months, which saw over 150 luxury vehicles seized for various offences, most of which involve not having a valid road tax and insurance coverage.

“When I met the individual who has become an ‘orang kena saman‘ (OKS), I asked why they came to court, and the answer was to pay a fine on road tax and insurance,” Muhammad Hasif told Berita Harian.

“The person explained that it was better to pay the (at minimum) RM300 fine, as it was cheaper and more worthwhile compared to paying over RM5,000 for road tax and more than RM10,000 for insurance for his continental car. If he just continues driving without road tax and insurance and gets fined, the maximum is only RM3,000. It’s more worth it,” he added.

“If he were to get into an accident and hit a member of the public while having no vehicle insurance coverage, the victim or their family would not be able to make any claims. In the end, they would have to bear all court and medical costs themselves,” Muhammad Hasif pointed out.

“Legal costs can reach up to RM10,000 to RM40,000, excluding medical and other court costs. In fact, even if they win the case, there’s no guarantee they will receive the compensation money,” he continued.

    I have been saying this ever since physical roadtax is not required to be displayed making these vehicles harder to be identified given the effectiveness of our enforcement officers.

    When there’s an accident, the police usually just inform the victim that the TP did not lodge a police report and they cannot do anything.
    However, when these culprits become a victim in an accident. they will claim against the other parties’ insurance for their losses.

    There are also cases where these culprits will directly inform the victim that their car don’t have insurance. Only way to claim losses for their cars is report the victim authored the accident being the guilty party in order to allow insurance claim to proceed. The culprit usually will verbally agree to pay the victim their NCD loss amount and saman cost… verbal only ok… no guarantee.

    Come on lah, this is Malaysia lah.
    Don’t tell me our enforcers don’t know about this.

    Sita the blardy cars and owners.Jail the blardy owners,for being a nuisance to the public in case of accidents,the aggrieved victim cant claim a sen from these bastards.
    JPJ already know these loopholes.Get parliament to bring new laws to punish these buggers,that they r liable whether they have insurance/road tax or not.

    Many people in this forum will react in disgust and anger with people who try to play the rule to their advantage. If you are rich enough to afford one of these lux vehicles, would you have done things differently? By law, they are actually abiding by the rule. The problem is the law, not the people who chose to play by it.

    Saman only RM300

    Kereta Sita doesn’t mean they don’t get the car back, pay the saman RM300 then renew insurance / roadtax. Car release back to owner. End of story? No…

    Owners then can also immediately change vehicle owner and get a refund for the insurance and roadtax. Change to who? anyone lah in the family also can. Yeah, can change ownership without insurance roadtax.

    Even more exciting if somehow they are connected, directly pay the saman and then change ownership without even going through the hassle of renewing the roadtax and insurance.

    Back to square one lah… still no need to renew insurance and roadtax.

    I have seen so much victims even some got amputations due to accidents caused by these so call luxury vehicles without insurance cover.

    Yeah, i know these first hand.

    ask them to come back every week to inspect if they have paid the road tax and insurance. each time they didn’t pay summon them RM3k…. 52 weeks (1 year) they didn’t pay, they would’ve paid a total of RM156k which is not economical for them.
