A legal amendment is being drafted to allow enforcement against consignors and consignees of cargo carried in overload lorries. This was said by Transport Minister Anthony Loke during a press conference in Kuala Lumpur, and reported by Bernama.
Speaking to reporters, Loke said the changes in the law is to hold the entire transport system accountable for overloading and that all cargo transported complies with legal limits. “We will be taking stricter action moving forward. I want to remind consignors and consignees that, currently, only drivers and vehicle owning companies are penalised for offences involving their lorries, including overloading,” said Loke.
Loke added work is being done on amendments to the law to ensure both senders and receivers of goods are also held responsible. “The entire eco-system must comply to ensure road safety,” he said.
“People often complain about potholes on Malaysian roads. One major cause is overloaded lorries. When roads deteriorate, not only do maintenance costs go up, but the safety risk, especially to motorcyclists, increases dramatically,” Loke added.
Loke further said quarry or factory owners will often pressure lorry drivers and transport companies to carry excess loads to reduce operating costs and remain competitive. “The Road Transport Department (JPJ) will be enforcing stricter measures, including meetings with quarry and sand operators to issue final warnings before stepping up enforcement,” Loke said.

Some JPJ dudes,reportedly exclude lorries that have been given ‘certain stickers”.
Enforcement is selective.
Until JPJ is cleaned up,overloading will continue.

You gotta be joking right. I hope they word the law properly, not everytime consignee or consignor knows how much the lorry is carrying, unless it was a dedicated run. Else who is to prevent the lorry/driver/transport company to carry more just to earn more per trip. It would be unfair to those who have no control over final loading on the truck!

Why don’t blame the lorry manufacturer, the cargo loader, the highway concessionaries for allowing the lorry to pass thru…etc etc etc.

First of all, the idea is somehow valid as Employers have right to dictate.
Since the target for this rule implementation is to counter “quarry or factory owners will often pressure lorry drivers and transport companies to carry excess loads to reduce operating costs and remain competitive”.
This would end up being another “Operation Cost” kinda summon.
Do consider to revoke licenses and confiscate properties/cargo as well to make it “Maybe Work”. lol….

If i’m sending an item via courier like Lalamove or Pos Malaysia, i am the consignor. Do I have check the current weight of the courier truck, check the registered BDM and verify if adding my item did not caused it exceeds the BDM?
YB, please focus only to the transporter company and the driver. Let them work out how to manage the loads since they are making money from this activity, they are the professionals. Don’t involve us public with trucks weight and cargo management whatsoever.
